    As the National Assembly reviews the Draft Amendment to the 2016 Pharmaceutical Law, expected to be passed in October this year, Mr. Nguyen Van Phuc, Managing Partner of HM&P Law Firm, shared his insights on the management issues related to the growth of pharmacy chains in an article on the online version of Vietnam Businessman on August 23, 2024.

    Pharmacy chains represent a modern pharmaceutical business model that meets the demand for convenience, reasonable costs, and high-quality services. With a system of pharmacies unified under the same brand, offering consistent services, high-quality medicines, modern business technology, and diverse after-sales programs, this model benefits both consumers and pharmaceutical companies. However, the challenge of effectively managing this model is significant for regulatory agencies, as the legal framework remains incomplete and subject to debate.

    As a legal expert in the pharmaceutical field, Lawyer Phuc shared his perspectives and proposals on managing pharmacy chains: “The retail distribution of pharmaceuticals through pharmacy chains has become increasingly common in recent years, with numerous chains operating across provinces and cities nationwide. However, the current legal framework does not yet specifically regulate this business model, creating difficulties for pharmaceutical companies that wish to establish and expand their pharmacy chains in practice.”

    While the Draft Amendment to the Pharmaceutical Law introduces new provisions regarding pharmacy chains, Lawyer Phuc emphasized the need for a more groundbreaking and specific legal framework. He suggested: “Instead of requiring businesses to establish individual pharmacies and then later declare a chain, businesses should be allowed to establish multiple pharmacies simultaneously, provided that each pharmacy meets the necessary conditions of a retail pharmaceutical establishment.

    In addition to these specialized mechanisms, Lawyer Phuc also stressed that businesses managing pharmacy chains must take on greater responsibilities than individual pharmacies. “Pharmacy chains, particularly those with a large number of outlets spread across many locations, pose a significant risk. If any product defects occur, they can quickly affect a large number of consumers. Addressing issues such as suspending sales, recalling products, or compensating consumers will become extremely complex and challenging.

    He highlighted the importance of stricter oversight by regulatory agencies, especially for pharmacy chains with large-scale operations across multiple regions.
