    HM&P Managing Partner presents at National Conference on Lawyer Law amendment

    On the morning of August 16, 2024, at Hall A.1002, Nguyen Tat Thanh campus, Ho Chi Minh City University of Law, in collaboration with the Ho Chi Minh City Bar Association, organized the national scientific conference titled "Comments on the Outline Orientation for the Development of the Law on Lawyers (Amended)”. Representing HM&P, Managing Partner Nguyen Van Phuc attended and delivered a significant presentation at the event.

    The conference was attended by Dr. Le Truong Son - President of Ho Chi Minh City University of Law; Prof. Dr. Do Van Dai - Vice President; Assoc. Prof. Dr. Tran Viet Dung - Vice President, along with leaders of various faculties and departments of the University. Additionally, the conference was honored by the presence of notable figures in the legal field, such as Dr. Lawyer Phan Trung Hoai - Vice President of the Vietnam Bar Federation; Lawyer Nguyen Van Trung - Chairman of the Ho Chi Minh City Bar Association; Master of Laws Nguyen The Phong - Member of the Standing Committee, Chairman of the Reward and Discipline Committee of the Vietnam Bar Federation; Dr. Lawyer Ha Hai - Vice Chairman of the Ho Chi Minh City Bar Association, Member of the Standing Committee of the Vietnam Bar Federation; and Master of Laws, Lawyer Nguyen Van Duc - Member, Head of the Training Committee of the Ho Chi Minh City Bar Association, along with many lawyer members of the Ho Chi Minh City Bar Association, representatives from various agencies and units, and law lecturers from universities across Ho Chi Minh City.

    In his opening speech, Dr. Le Truong Son emphasized: “The Law on Lawyers of 2006 has played a crucial role in creating a solid legal framework for the legal profession and law practice organizations, contributing to the protection of justice, democratic freedoms, and the legitimate rights and interests of individuals and organizations. However, after more than 17 years of implementation, the Law has revealed some limitations, necessitating amendments and supplements to align with the realities of societal and professional development.”

    The conference received 33 papers from lecturers, experts, and scholars inside and outside the university, focusing on two key topics: (1) Standards, training, and apprenticeship of lawyers; (2) Activities, organization, and management of the legal profession. The conference was divided into two sessions, with six presentations delivered, including the one by Lawyer Nguyen Van Phuc titled "State Management and Support for the Legal Profession: The Need for Practical and Substantial Regulations."

    In the first session, the presentations focused on analyzing and evaluating the new provisions in the Outline Orientation for the Development of the Law on Lawyers (Amended) by comparing them with existing legal regulations, aiming to clarify the concepts and standards for lawyers, as well as introduce new points related to ensuring the quality of the Vietnamese lawyer workforce.

    The second session delved into the theoretical issues surrounding legal services provided by lawyers, the conditions for foreign law firms operating in Vietnam, current management regulations, and proposals to enhance the responsibilities of state agencies and the self-governance capacity of professional legal organizations.

    At the conference, with nearly 15 years of practical experience and many years of managing HM&P under a professional model, close to leading law firms in Vietnam and internationally, Lawyer Nguyen Van Phuc presented his paper on "State Management and Support for the Legal Profession: The Need for Practical and Substantial Regulations." His presentation offered a comprehensive perspective and practical recommendations aimed at improving the legal framework and facilitating the sustainable development of the legal profession in Vietnam. He noted that while the 2006 Law on Lawyers had achieved positive results, it still has certain limitations that require timely adjustments to keep pace with the increasingly deep international integration.

    After both sessions, to further clarify issues and discuss solutions, the experts engaged in lively discussions on topics such as the participation of foreign law firms in Vietnam, individual lawyer practice, professional management, and state support. Lawyer Nguyen Van Trung, Chairman of the Ho Chi Minh City Bar Association, summarized the key issues and proposals, which will be recorded by the Ho Chi Minh City University of Law and the Ho Chi Minh City Bar Association and submitted to relevant authorities for consideration in the process of amending the Law on Lawyers.
